Child Support, Spousal Support, or Child Custody Modifications
If you already have a Child Support, Spousal Support, or Child Custody order in place it is possible to make a change. The court has the power to change orders relating to spousal support or the custody, parenting time, visitation, and support and welfare of a child. A divorce lawyer can assist you in evaluating and completing the modification process.
A material change in circumstances might require a modification of your divorce order. Some types of material changes include:
- Loss of employment or other reduction in income
- Military service abroad by either parent
- Alcohol or drug abuse
- Allegations of domestic violence, child abuse, or neglect
- One parent plans to move out of state and wishes to revise the custody and visitation schedule
If you or your former spouse have experienced a significant change in circumstances and you think that modifying your divorce order is appropriate then a divorce attorney can assist you.
Modifying Property Settlements
Except in extraordinary circumstances, a court will not modify a judgment relating to the division of marital property.
If, however, a party in a divorce proceeding inadvertently failed to disclose certain property, committed fraud, or engaged in other types of unusual conduct you may be able to modify your property division. Strict time limits apply in seeking modifications of property settlements so it is important to obtain legal advice regarding your specific situation.
